Divorce by way of Mutual Consent means, both husband and wife has agreed amicably among themselves that they cannot live together anymore and they have adopted the best solution to Dissolve their marriage without putting forth any allegation, case or litigation against each other. To give legal cover, a declaration or we can say it a divorce deed is drafted on Stamp paper of worth 50 rupees and is signed jointly by both parties i.e husband & wife. Divorce By Mutual consent saves time, money and energy for both (husband & wife) and also leaves no room for unnecessary quarrel and most importantly avoid washing your dirty linen in public. All issues between husband & wife i.e dissolution of marriage, custody of child, Alimony (maintenance of child & wife), returns of items (dower, Jahaiz articles, etc) can be settled mutually by writing these as settled terms in said divorce deed. This mutual consent divorce deed is like a joint statement. After signing, the the marriage is dissolved and from the date of signing, the wife / widow is supposed to observe iddat period (three months). The proposed draft of Divorce deed by way of mutual consent, is given here under, after signing it by both parties, the law require the parties to get it attested by NOTRY PUBLIC and to approach the office of Town Municipal Administrator (TMO) for obtaining confirmation certificate of Divorce.

This Deed of Divorce by way of mutual consent is
made at Karachi on this_______ day of September 2013.
Between
Mr. _________________________ S/o __________________________, Muslim, adult, holding N.I.C No: ____________________,
resident of house No.____________________ , Gujranwala. (Hereinafter
referred to and/ or called as the party of first part).
AND
Mst.___________________D/O _____________________, muslim, adult, holding NIC No;____________________________, resident
of Flat No.________________________ Karachi. (Herein after
referred to and/ or called as the party of Second part).
That on 28-Nov-2010,
the marriage between both the parties was solemnized and out this wed lock no
issue / Baby is born. Due to some matrimonial disputes it is hereby agreed
between the parties on the terms and conditions herein below.
1. That the Second party hereby wave the right Haqmaher & maintenance
in lieu of Divorce pronounced by the First Party.
2. That the Second party has taken back the dowry articles and
acknowledges hereby for the same with the signing of this deed.
3. That in continuation of agreed terms of above said, the first party
herby pronounce the divorce thrice as follows: -
1. I Syed Talsh (First Party) divorce to my Wife Wftir
(Second Party).
2. I Syed Talsh (First Party) divorce to my Wife Wftir
(Second Party).
3. I Syed Talsh (First Party) divorce to my Wife Waftir
(Second Party).
4. That the Second party is no more wife of First party by the signing of
this deed.
