DECLARATION / WAKF FOR PUBLIC PURPOSE / GIFT DEED

This Gift Deed / Declaration / Wakf for public purpose is made  at Karachi on this 08th day of February 2017 BY AND BETWEEN (1) Mr. Umer Farooq S/O Muhammad Ishaq, Muslims, adults, resident of  Hose No: A680, Sector 11-G, Godhra Cooney, New Karachi, Karachi, holder of CNIC No. 42101-1654877-3, (hereinafter referred to as “the Donor / Grantor " which expression shall mean and include his/her legal heirs, legal representatives, executors, administrators and assigns) of the First Part.
AND
Madrassah Hudal Lil Aalmeen (Registered Under Societies Registration Act Vide registration: KAR NO: 2085 of 2014-2015) through its President / Administrator - Mr. Sajjad Ahmed S/O Faqeerullah,  Muslims, adults, resident of  House / Plot No: 517, Sector 50-E, Lyari Express Way, Taiser Town, Karachi, holder of CNIC No. 31303-67267536, (hereinafter referred to as “the Donee / Trustee" which expression shall mean and include his/her legal heirs, legal representatives, executors, administrators and assigns) of the Second Part.
WHEREAS:
The first Part / Donor / grantor is the absolute owner of immoveable properties mentioned in scheduled hereunder and it is desired for Fie-Sabi-Lillah to assure this property conveyed as a mosque & Madrassah for the benefits and use of the Muslims/Muhammadan Community and for the purpose of construction of Mosque & Madrassah for sayings divine prayers & for teachings of Islam according to tenets of Muhammadan faith.
NOW THEREFORE THIS DEED WITNESSTH AS FOLLOWS:
1.      That the first Part / Donor / grantor is desirous to give / hand over / deliver /the scheduled property hereunder, to “the Donee / Trustee” for construction of mosque & Madrassah, in consideration of Fie-Sabi Lillah & out of natural love and affection, of his/her own free will and without any force or compulsion and the “the Donee / Trustee” is willing to accept the same.
2.      That “the Donee / Trustee” in appreciation of charitable & for preaching’s of Islam, has already carried out by establishing Madrassah for Girls and as a mark of respect for “the Donee / Trustee” and its esteem, the “first Part / Donor / grantor” hereby gratuitously grants, transfers, conveys and assigns by way of charity or gift scheduled property hereunder with all the rights, titles, interests, benefits, etc. to therein in favor of “the Donee / trustee”.
3.       That the “first Part / Donor / grantor” has hereby divested himself/herself/itself of the custody and ownership of scheduled property hereunder and shall be free to instruct his/her/ participant City District Government – Lyari Express Way resettlement Project Land Department to transfer the scheduled property hereunder in the name of “the Donee / Trustee”.
4.      That the “first Part / Donor / grantor”  confirms, represents and assures that scheduled property hereunder, are free from all claims, liens, pledges, charges, prior gifts, bequests, inheritance claims, disputes, adverse titles or encumbrances of whatsoever nature.
5.      That henceforth “the Donee / Trustee” shall be the exclusive lawful owner of the scheduled property hereunder and shall be entitled to receive all dividends, bonus shares, rights, entitlements and other benefits accruing thereon and for purpose of to achieve object / intention of the “first Part / Donor / grantor” shall also be entitled to hold, deal with, transfer, alienate, encumber, gift, pledge, sell or dispose of the whole or any part of scheduled property hereunder, as the exclusive lawful owner thereof.
6.      That “the Donee / Trustee” shall manage the whole affairs of subject matter in such a manner as a prudent man manages his own affairs and “first Part / Donor / grantor” shall not be liable or responsible for any damages, loss, default, neglect or illegal act of “the Donee / Trustee”.

1.   Plot No: L-688, Measuring 80 Sq Yards, Sector 50-E, Lyari Express way resettlement project, Scheme 45, Taiser Town, Karachi.
